Terms & Conditions for Digital Products and Online Courses

These Terms & Conditions for Digital Products & Online Courses (“TC”), together with our Terms of Use (www.theinsidetrackcareers.com/terms-of-use), set out the terms and conditions that will apply when you purchase a digital product or enroll in an online course from www.theinsidetrackcareers.com. If you are unable to understand or have any questions about these Terms, please contact us BEFORE placing your order.

You will be required to confirm that you have read and accept these TCs before you submit an order. Please note that these TCs are subject to change so review and save or print a copy of these terms before each order that you submit.

Overview

These TCs do not affect your legal (statutory) rights under your applicable state laws relating to the sale of consumer products.

Order and Acceptance

Each order submitted constitutes an offer to purchase a digital product or online course from us. Orders are subject to our acceptance and we may, at our discretion, refuse to accept your order, including where:

- orders cannot be processed due to an error in the information you have provided to us;

- there is an error on our site relating to the product or course that you have ordered, for example, an error relating to the price or description of the product/course as displayed on our site; or

- the product/online course that you have ordered is no longer available through our site.

We will, unless we suspect that your order was placed for fraudulent purposes, send you an email if we are unable to accept your order, informing you of the reason.

Product Availability

We will have the right, at any time, to make changes to information about the products/online courses displayed on our site, for example, information about prices, descriptions, or the availability of products/courses and we may do so without first giving you notice of the changes. We will not, however, make any changes to the price, availability, or description of any product/course after we have accepted an order to deliver the product/online course to you.

Prices and Payment 

The product/course price is always the price indicated on the website when you place your order. The price does not include tax (where applicable).

Payments are processed through our online payment processors, Stripe and PayPal. You understand that by purchasing through our website, you are also agreeing to the terms and conditions of Stripe and PayPal.

Refunds/Cancellation

No Refunds: Due to the nature of our online courses, all PayPath Foundation – Coach Edition sales are final once course access has been granted. All PayPath Foundations – Seeker Edition and PayPath Foundations – Grad Edition sales are final once onboarding has begun. After course access has been granted/onboarding has begun, there is a strict no-cancellation/no-refund policy. For this reason, we want you to be very sure that the time is right for you to make this commitment.

To be eligible for a refund prior to the start of your purchased program, you must submit a request in writing by sending an email to: [email protected] no later than 48 hours prior to the first scheduled coach pre-work session for Seeker and Grad Editions. After courses go live, access and onboarding typically begin within 24 hours; coaches who pre-order will be notified at least 48 hours before the course is live.

Online Sessions/Masterclasses/Lessons/Modules  

The content for our products/courses is made available through a third-party membership site with a secure server, and we have taken all reasonable steps to ensure that the online content will be available at all times. However, if the content is not available in whole or in part at any time, or becomes corrupted, is deleted, or fails to be stored, we shall have no liability under any circumstances. 

Our Relationship With You

PayPath Foundations — Coach Edition is an online course and you fully agree and understand that a 1-1 relationship does not exist between you and us during or after the conclusion of this Course. If you would like to engage us in 1-1 consulting/coaching services, we will have a separate discussion, and should we decide to enter into a 1-1 relationship, we will both review and sign a separate agreement to that effect.

PayPath Foundations — Seeker Edition and PayPath Foundations — Grad Edition involve 1-1 meetings with you and group meetings with your clients. You fully agree and understand that this is not a career coaching relationship and that you will receive no personal coaching as a result of your purchase. You fully agree and understand that the relationship ends after the purchased cohort ends. If you would like to engage us in further services for your clients, you will purchase a new cohort.

Passwords

You agree to keep your user details and your password for the membership/course site confidential at all times and you shall not disclose them to any third party. You must notify us immediately if you become aware of any unauthorized use of your account and you shall indemnify us against all claims, damages, losses, costs, or expenses, and any other liability that arise from any unauthorized use of your account. 

Intellectual Property  

You understand and agree not to use or infringe any copyright, patent, trademark, trade secret, or other intellectual property rights of Smart Girl Wordsmithery LLC, doing business as (DBA) The Inside Track Career Services. All material distributed to you during your participation in this Course is proprietary, copyrighted, and developed solely and specifically for Smart Girl Wordsmithery LLC, DBA The Inside Track Career Services. All materials, procedures, policies, and standards, all teaching manuals, all teaching aids, all supplements, and the like, that have been or will be made, are for your personal use in or in conjunction with this Course only. Original materials that have been provided to you are made available for individual use only and a single-user license. Any disclosure, reproduction, or sale to a third party is strictly prohibited. Course content may not be sold, tape-recorded, videotaped, shared, taught, given away, or otherwise divulged without the express written consent of Smart Girl Wordsmithery LLC, DBA The Inside Track Career Services. No license to sell or distribute our materials is granted or implied.

Confidentiality and Non-Disparagement

We respect your privacy and insist that you respect our privacy. Any Confidential Information shared by other course participants or any representative of Smart Girl Wordsmithery LLC, DBA The Inside Track Career Services, is confidential, proprietary, and belongs solely and exclusively to the person who discloses it. You agree not to disclose, reveal, or make use of any Confidential Information verbally or in writing.

You also agree that neither you nor any of your associates, employees or affiliates will directly or indirectly, in any capacity or manner, make, express, transmit speak, write, verbalize or otherwise communicate in any way (or cause, further, assist, solicit, encourage, support or participate in any of the foregoing), any remark, comment, message, information, declaration, communication or other statements of any kind, whether verbal, in writing, electronically transferred or otherwise, that might reasonably be construed to be derogatory or critical of, or negative toward, Smart Girl Wordsmithery LLC, DBA The Inside Track Career Services, or any of our programs, members, owner directors, officers, Affiliates, subsidiaries, employees, agents or representatives.

Liability and Indemnification

To the extent permitted by law, Smart Girl Wordsmithery LLC, DBA The Inside Track Career Services, shall not be liable to you or anyone else for loss or damage of any kind (however caused or arising) relating in any way to this website or your purchase of our digital products, including, but not limited to, loss or damage you might suffer as a result of:

- errors, mistakes, or inaccuracies on the website;

- you acting, or failing to act, on any information contained on or referred to on the website and/or any linked website;

- personal injury or property damage of any kind resulting from your access or use of the website;

- any unauthorized access to or use of the website's secure servers;

- any interruption or cessation of transmission to or from the website;

- any bugs, viruses, trojan horses, or other harmful code or communications that may be transmitted to or through the website by any third party; and/or

- the quality or fitness for any purpose of any linked sites.

You will at all times indemnify Smart Girl Wordsmithery LLC, DBA The Inside Track Career Services, including our directors, officers, employees, and agents from and against any loss (including reasonable legal costs and expenses on a full indemnity basis) or liability incurred or suffered by you arising from any claim, demand, suit, action or proceeding by any person against you where such loss or liability arose out of, in connection with or in respect of your conduct or breach of these terms.

No Guarantees/Disclaimer

You must understand we are not an agent, lawyer, manager, therapist, or psychotherapist for you or your clients. Your and your clients' participation in our Courses will not guarantee any life, business, career, or health-related results. If you should experience any health, business, career, financial, or legal issues, you should seek advice from your doctor, psychiatrist, financial advisor, accountant, attorney, or other professional as determined by your judgment.

Because of the nature of our products and events, the results experienced may significantly vary from client to client. Although we are confident that the content in this product will transform your clients’ career outcomes, we can’t make any promises to you and will not deliver any guaranteed outcomes as a result of following the recommendations outlined in the products. The outcome and results you experience depend on your and your clients’ level of commitment to implement the strategies given.

General Terms

This TC Agreement is governed by and shall be construed in accordance with the laws of the State of Maryland, without reference to its conflict-of-law provisions.

Entire Agreement

This TC Agreement constitutes the entire agreement between Smart Girl Wordsmithery LLC, DBA The Inside Track Career Services, and you concerning your purchase of products from this website, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and Smart Girl Wordsmithery LLC, DBA The Inside Track Career Services, concerning this website.

A printed version of this TC Agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings based on or relating to this TC Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

ELECTRONIC COMMUNICATIONS AND ELECTRONIC SIGNATURES

You agree to be bound by any affirmation, assent, or agreement you transmit through this website, at any point in which you click on an “I agree,” “I consent,” or other similarly worded “button” or entry field with your mouse, keystroke, or other computer devices, or when you enter your credit card information to complete your purchase, your agreement or consent will be legally binding and enforceable and the legal equivalent of your handwritten signature.
